Penalties for Aggravated DUI in Denver
A standard first-offense DUI in Colorado carries 5 days to 1 year in county jail, fines of $600 to $1,000 plus court costs, 48 to 96 hours of community service, a 9-month license revocation, and 12 DMV points. Aggravating circumstances raise each of those numbers and add requirements that don’t disappear through a plea.
- BAC 0.15% or higher (PDD designation): Mandatory IID for at least 2 years after reinstatement, even on a first offense.
- BAC 0.20% or higher: Mandatory minimum 10-day jail sentence, though the court may use certain sentencing alternatives where permitted.
- Two or more prior convictions: At least 60 consecutive days in county jail, not reducible during the mandatory period.
- Permanent criminal record: Colorado doesn’t expunge DUI convictions. The record remains indefinitely and can affect professional licenses, CDL status, and employment background checks.
- Separate administrative track: The DMV’s administrative license revocation runs independently of the criminal case. A favorable criminal outcome doesn’t automatically restore driving privileges.
CDL holders face a 1-year disqualification on a first DUI conviction and a potential lifetime disqualification on a second. Professionals subject to licensing boards may face separate proceedings triggered by a DUI conviction.
