Colorado divides familial sexual allegations into two primary categories, depending on the age and exact relationship of the individuals involved:
Standard Incest (C.R.S. § 18-6-301)
Standard incest occurs when an individual knowingly marries, engages in sexual intercourse, or subjects another person to non-consensual or consensual sexual contact if that person is a close relative.
Under the law, this explicitly includes:
- Biological parents, grandparents, or ancestors.
- Adult children, adopted children, or stepchildren aged 21 or older.
- Siblings (including half-blood brothers and sisters).
- Aunts, uncles, nephews, or nieces of the whole blood.
The penalty: Standard incest is a Class 4 felony.
Aggravated Incest (C.R.S. § 18-6-302)
The charge escalates to aggravated incestunder two distinct circumstances:
- The defendant engages in sexual behavior or marries their natural child, stepchild, or adopted child who is under 21 years of age.
- The defendant engages in sexual behavior or marries a descendant, sibling, aunt, uncle, nephew, or niece who is under 10 years of age.
The penalty: Aggravated incest is a severe Class 3 felony.
