First Offense DUI Penalties in Colorado

Under C.R.S. § 42-4-1307, a first-time DUI conviction in Colorado is classified as a misdemeanor and carries a strict mix of both criminal court penalties and administrative DMV consequences. 

Criminal Court Penalties

  • Jail time: A first-time DUI conviction can carry a sentence of five days to one year in jail. In some situations, the minimum jail term may be suspended if statutory requirements are met, while higher BAC allegations can affect sentencing. 
  • Fines: A first-time DUI conviction can carry fines in addition to court costs and other required fees. 
  • Useful public service: 48 to 96 hours of mandatory community service. 
  • Probation: A first-time DUI conviction may also include probation with conditions set by the court. 
  • Alcohol education and therapy: The court may require alcohol education, treatment, or both, depending on the circumstances of the case. 
  • Administrative & DMV Penalties 
  • License revocation: A first DUI often results in an administrative license revocation, with early reinstatement available if DMV requirements are met. 
  • Driver's license points: A DUI-related restraint may also result in points on your driving record, depending on the charge and the DMV action.
